Terms and Conditions of Sale

‍These Terms and Conditions of Sale (the "Terms") are concluded between, on one hand, the website nynerdlyvisuals.com, operated by Nynerdly Visuals, a sole proprietorship registered under SIRET number 929 855 815 00015, with its registered office located at 60 Rue François Ier, 75008 Paris, France, and on the other hand, any natural person who is not a trader ("Customer") wishing to make a purchase on the nynerdlyvisuals.com website.

I. OBJECT

These terms aim to define the conditions for ordering, payment, delivery, and after-sales service between nynerdlyvisuals.com and the Customer.

II. PRODUCTS

Nynerdly Visuals offers for sale clothing and posters. Each product is described and presented as accurately as possible. Minor variations in colors, sizes, or other features may exist depending on displays and production batches.

All products are subject to availability. In case of unavailability, the Customer will be promptly informed by email.

III. ORDER

‍The Customer can select the products they wish to purchase and add them to their "Cart." Once the order is finalized by clicking "Finalize Order," the Customer will be asked to provide the necessary information for the order (contact details, delivery address, payment method).

Acceptance of these Terms is mandatory to complete the order. Once validated, the order is confirmed by email. The sale is then considered final, subject to product availability.

IV. PAYMENT

Payments on nynerdlyvisuals.com are secure and processed via the payment methods offered by Webflow, including:

- Stripe
- PayPal (if activated)

No additional fees are applied for using these services. All payment information is handled securely and encrypted. Payment data is not stored or accessible by Nynerdly Visuals.

V. DELIVERY

‍Orders are shipped via professional delivery services such as Colissimo and Mondial Relay, depending on the destination. Shipping fees are indicated at the time of ordering.

Processing and shipping times are typically 3 to 5 business days after order confirmation but may extend up to 10 business days during peak periods and in some cases, up to 2 weeks. If you have not received your order within 3 weeks, please contact us at hi@nynerdlyvisuals.com. A tracking number will be provided to the Customer once shipped.

For orders within France, shipments are primarily made via Colissimo. International deliveries may be handled via Mondial Relay or another carrier, depending on availability.

VI. RIGHT OF WITHDRAWAL

The Customer has a period of 14 days from the receipt of their order to exercise their right of withdrawal, in accordance with Article L.121-20 of the French Consumer Code.

Returned products must be in their original condition, unworn, unwashed, and with original tags.

Return shipping costs are the responsibility of the Customer, except in cases of non-conformity of the received product.

Exclusions : Custom or promotional items cannot be returned or refunded.

VII. WARRANTIES

All products are covered by the legal warranty of conformity (Articles L.217-4 and following of the French Consumer Code) and the warranty against hidden defects (Articles 1641 and following of the Civil Code). If a product is defective or non-compliant, the Customer should contact customer service at hi@nynerdlyvisuals.com to arrange for an exchange or refund.

VIII. PRE-ORDERS

8.1 What is a Pre-order?

A pre-order allows customers to reserve products before they are manufactured. When a pre-order is placed, production will start once the pre-order period ends. Delivery times for pre-orders will be indicated on the product page and may range from 1 to 4 months. These times are approximate and may be adjusted based on circumstances. Any significant changes will be communicated to the customer.

8.2 Payment Terms

Payments for pre-orders are made in full at the time of ordering. Amounts paid are not considered as deposits, according to Article 1590 of the Civil Code. Pre-orders are non-refundable but can be exchanged or credited. Return conditions are the same as those applied to other orders.

8.3 Pre-order Goal

If the minimum number of pre-orders is not reached, we will inform the customer at the end of the pre-order period. Depending on the situation, we will offer either a full refund or production of the items if possible. In the case of a refund, it will be processed within fourteen (14) days from the cancellation of the pre-order.

8.4 Cancellation by the Customer

Pre-orders can be canceled by the customer within 14 days from the date of the order. To cancel a pre-order, please contact our customer service at hi@nynerdlyvisuals.com. After this period, the pre-order will be considered firm and final.

8.5 Modifications and Adjustments

Nynerdly Visuals reserves the right to modify the details of the pre-order, including delivery times and product specifications, before the start of production. In case of substantial modification, we will inform the customer who can then choose to cancel the pre-order.

IX. INTELLECTUAL PROPERTY

All elements of the nynerdlyvisuals.com website, including images, texts, logos, and the Nynerdly Visuals brand, are protected by intellectual property laws. Any partial or total reproduction is prohibited without prior authorization.

X. PERSONAL DATA

Customer personal data is collected and processed in accordance with the Privacy Policy available on the site. It is used solely for managing orders and customer relations.

XII. MODIFICATIONS OF THE TERMS

Nynerdly Visuals reserves the right to modify these Terms at any time. Changes will be effective upon publication on the nynerdlyvisuals.com site. It is the Customer’s responsibility to regularly review the Terms to stay informed of any changes.
